Blocking trademark registrations
A nutrition products company came to us with a pending trademark application for their desired business name rejected based on a likelihood of confusion with two prior registrations. Our research showed the owner of the two registrations was not presently selling products under the trademarks and had likely never done so. Using leverage from a cancellation proceeding in the Trademark Trial and Appeal Board, we negotiated a sale of the blocking trademarks to our client. As our client is now the owner of the blocking trademarks, their path to registration of their desired trademarks is now clear and progressing smoothly.
